("MCCPE") be treated as timely filed and request that the penalty for late filing be abated because the delay was due to reasonable cause. According to IRM 20.1.1.3.2, Reasonable cause, the IRS provides relief from a penalty based on reasonable cause when the taxpayer exercised ordinary business care and prudence in determining their tax obligations but was unable to comply with them.MCCPE engaged an accounting firm to file its 2022 Form 990 by 2/3/2025 under the Hurricane Beryl disaster relief. The irregular filing due date of the 2022 Form 990 and the engagement of and transition to an accounting firm after 1/15/2025 led to an unintentional oversight. The MCCEP did not file for an extension of its 2023 Form by 1/15/2025 for an extended due date of 7/15/2025.Upon discovering the oversight, the accounting firm set up MCCEP in its systems to meet filing deadlines and has prepared the 2023 Form 990 for filing by 7/15/2025.MCCEP has had no prior penalties for late filing. Based on the above facts, we respectfully request the abatement of all late filing penalties.
