The organization meets the facts-and-circumstances test in Regulations section 1.170A-9(f)(3) because it maintains a continuous and bona fide program for solicitation of funds from the general public, community, governmental units, or other public charities, and other facts and circumstances as described below that satisfy this test.The organization maintains well-defined ongoing programs to accomplish charitable work by forging science, ethics and law into tools for action in service to communities, the earth and future generations.In 2021, the organization received a large grant from a trust that was spread out over three years that was given to initiate a new program and recruit more donors to support that program. We have received a terminal grant of $250,000 from the trust in 2024 and will no longer receive funds from them as they are closing the trust.In 2021, our public support was at 34.11%, which allowed us to meet the public support test for that year and the two prior years (38.35% in 2020 and 43.96% in 2019). Given the larger donations received above from the trust over the last couple of years, our public support percentage decreased. We anticipate that in 2025 our funding portfolio will more closely resemble 2021 and we will be able to exceed the public support test of 33 1/3%.We are working on diversifying our income sources and in 2023 have received funds from three new foundations. Given our efforts, the number and diversity of donors has been increasing. We will be pursuing individual donors and smaller foundations to bring our public support numbers back to over 33 1/3%.
