In 2022 NVCT, during a regular monitoring visit to the property, discovered two violations that involved the location of a patio within a setback and the paving of a parking area. It was determined that requiring removal of these improvements would cause more damage to the property than allowing them to remain; provided that the easement was amended to create an overall increase in protection of the conservation values of the property and offset any private benefit. The amendment (i) removes the landowner's right to timber the property, previously permitted by the easement; (ii) reduces the total amount of structures permitted by the easement; and (iii) increases protection of the watershed. Part II, Line 5: The Northern Virginia Conservation Trust's (NVCT) policy is to enforce the terms of its conservation easements and protect their conservation values. Enforcement serves to: Maintain the conservation values of protected land; Maintain string working relationships with landowners; Increase public confidence in NVCT; Deter potential offenders from violating conservation easements; Protect and maintain NVCT's status as an accredited land trust. Staff take a front line role in observing and evaluating potential easement violations and pursuing resolution appropriate for the staff level, while the Board of Directors is involved in more complex resolutions and bears ultimate responsibility for defending and upholding NVCT's easements. NVCT's philosophy upon discovering potential violations is to appreciate that the landowner may not have intentionally committed a violation or may be unaware of a third-party violator of the conservation easement. Upon learning of a potential violation, staff take the following actions: document the violation, review existing documentation to determine if the situation is in fact a violation, and contact the landowner to inform them of the matter, ask for information and questions from them, and discuss options for remedying the violation. NVCT's policy is to work with landowners as flexibly as possible in remedying the situation, to provide timeframes for expected action, and to connect landowners with advice or resources as needed to remedy violations. NVCT recognizes three categories of violations: technical, minor, and major. NVCT responses and escalations are phased accordingly. NVCT views litigation or other legal means to address an easement violation as a last resort. Part II, Line 9: The Trust holds 131 conservation easements as of June 30, 2023. This compares to 129 conservation easements held on June 30, 2022. The purpose of the conservation easement is to preserve and protect the environment of the properties and to permanently maintain the open-space value and character of the associated real property. The conservation easements held by the Trust were all obtained via gift deed from the property owner of record at the time of donation. Since these easements have no marketable value, the Trust's policy is to assign a nominal value of $100 per easement and record as conservation easement asset in the accompanying statements of financial position. At June 30, 2023 and 2022, conservation easements were $13,100 and $12,900, respectively. Part V, Line 4: The Trust's Board-designated quasi-endowment fund (also referred to as "the Stewardship Fund") was established to support long-term responsibilities that are accepted by the Trust with each conservation easement. If there is a conflict of interest the parties involved are asked to disclose the conflict using the COI form.
