Often BayLegal resolves multiple interconnected legal issues for families to improve their overall self-sufficiency and quality of life. In addition to BayLegal's primary work providing direct individual legal services to low-income clients BayLegal triages limited resources for greater community impact through extensive outreach and community education legal clinics and workshops technical assistance to other community and governmental agencies and systemic advocacy and impact litigation. The following client story provides a brief example of how BayLegal's services change lives: A BayLegal client received an eviction notice from the landlord of her apartment building along with five other tenants several of whom like her had lived in the building for many years. The landlord sought to evict all tenants under the guise of complying with the local building inspector's orders to substantially remodel the building. The client has accommodation needs relating to a disability and had recently lost her job due to the COVID-19 economic contraction which would have made it difficult for her to relocate on short notice. Without legal assistance she faced the real possibility of homelessness. BayLegal and a partner organization worked together to provide legal representation to all tenants and prevent displacement of the community. In coordination with an expert consultant BayLegal and the partner organization disputed the substantial renovation claim completed six depositions and prepared for a jury trial. On the eve of the trial the landlord settled dismissing all six evictions including the eviction against BayLegal's client. The defense team secured a contractual agreement protecting all affected tenants from any further no-fault eviction claims for as long as the current owner retains possession of the property; a waiver of 2.5 months rent; tenants right of first refusal in a potential sale of the property to a land trust; and maintenance of their monthly rent at the rate that was in place before the eviction action began. BayLegal's client remains stably housed along with her neighbors and is relieved to no longer face the financial and personal anxiety of potential homelessness. BayLegal balances direct individual services with systemic work to address root causes of issues harming low-income residents and extend our impact at a scale far beyond the tens of thousands of individual clients and family members we directly serve each year. By working directly with clients and low-income communities BayLegal develops expert knowledge of the problems and legal barriers that harm people living in poverty and impede their struggle for self-sufficiency. Systemic work informed by our individual work with clients includes impact litigation legislative and administrative advocacy and training technical assistance and policy development for agencies that administer housing healthcare and public benefits programs for the Bay Area's low-income residents.The following description provides an example of the widespread impact of BayLegal's systemic advocacy: Bay Area Legal Aid along with two other civil legal rights organizations sued San Mateo Superior Court and the Judicial Council for illegally imposing a hidden $300 late charge called a civil assessment on traffic court defendants for missing a court payment or appearance deadline.These fees - automatically assessed without judicial review adequate notice or consideration of a person's circumstances - resulted in tremendous and unfair burdens on low-income Californians. The lawsuit also alleged the trial court funding scheme created a conflict of interest and incentive for Superior Courts to impose the maximum late charge since the funding scheme rewarded each Court by allowing them to keep extra civil assessment revenue collected. BayLegal's litigation provided pressure in legislative efforts resulting in the enactment of AB-199. This law eliminated the alleged conflict of interest by depositing civil assessment money into the state general fund and distributing it through the regular appropriations process. It also reduced the maximum civil assessment amount from $300 to $100. Also the 2022-23 California budget eliminated previously imposed civil assessment debt which the complaint alleged was illegally imposed due to the conflict of interest. As a result of negotiations the Judicial Council rescinded its guidance that encouraged courts to impose civil assessments on all infraction failure to appear and failure to pay cases and the San Mateo Superior Court announced an internal policy to no longer impose civil assessments. At least nine other court systems have discontinued their unlawful late fee programs. Debt Collective v. Recent studies have confirmed that investing in legal services is a cost-effective means of solving issues faced by people who are low-income and BayLegal's data confirms that every dollar invested in our annual budget has produced an average of $2.15 in economic benefits to low-income families over the past four years. While BayLegal continues to strategically develop its programs to ensure they are responsive to the ongoing and emerging needs of the diverse populations it serves the receipt of flexible funding is increasingly important for the provision of high-quality services to low-income people and communities ensuring fairness for all in the justice system.
